In respect of the fees of arbitrators,
the DIS Schedule of Costs has remained largely unchanged since 1992 – taking
into account only the introduction of the Euro in 2002. The
need for some adaptation of the arbitrators' costs to the general economic
development has therefore arisen.
The amended version of the Appendix to
Sec. 40 sub. 5 of the DIS Arbitration Rules (Schedule of Costs) will be
effective as of 1 January 2005.
With the amendment, the fees of arbitrators in cases where the amount in dispute
exceeds 50.000 EUR have been increased somewhat. In addition, arbitrators' fees
may be increased by up to 50 % in factually or legally
highly complex cases. Furthermore, when a counterclaim is filed, the fees of the
arbitrators may be calculated separately on the basis of claim and counterclaim.
The Appointing Committee of the DIS will decide on such increases upon
application of the arbitrators and after having given the parties an opportunity
to comment on such application.
The DIS has also issued guidelines for
the reimbursement of arbitrators' expenses pursuant to Sec. 40 sub. 1 of the DIS
Arbitration Rules.
The amended Schedule of Costs will apply to all cases newly
filed on or after 1 January 2005.
