DIS-Statistics 2010

In 2010, the DIS was entrusted with the administration of a total of 156 (2009: 176) new proceedings.

A total of 155 (2009: 172) new arbitral proceedings were commenced at the German Institution of Arbitration (DIS).

131 proceedings were initiated under the DIS-Arbitration Rules (2009: 164), including 2 proceedings initiated under the Supplementary Rules for Expedited Proceedings (DIS-SREP 08) and 2 proceedings under the Supplementary Rules for Corporate Law Disputes (DIS-SRCoLD 09).

4 proceedings were based on the Arbitration Rules of the Frankfurt Chamber of Industry and Commerce, 3 proceedings on the Arbitration Rules of the Chamber of Industry and Commerce of Berlin, 2 each on the Arbitration Rules of the Chambers of Industry and Commerce of Stuttgart and Cologne, and 1 each on the Arbitration Rules of the Chambers of Industry and Commerce of Ulm, Munich and Darmstadt. The Arbitration Rules of these Chambers of Industry and Commerce refer to the DIS Arbitration Rules and are administered by the DIS (14 proceedings in total under the Rules of Chambers of Industry and Commerce; 8 such proceedings in 2009).

The amounts in dispute of the cases filed range from € 2,856 to € 650,000,000. The aggregate amount in dispute of all cases filed directly with the DIS in 2010 amounted to approx. € 1.090 billion (2009: € 1.172 billion) and € 1.142 billion (2009: € 1.223 billion) including extensions of claims and counterclaims filed in 2010 in proceedings commenced in previous years. Including claims filed under the Arbitration Rules of the Chambers of Industry and Commerce, the total amount in dispute amounted to approximately € 1.147 billion (2009: € 1.225 billion).

In 43 proceedings (2009: 45) foreign parties were involved (29.7%) (2009: 26.2%). In 33 of these proceedings (2009: 35) one foreign party was involved on either the claimant or respondent side. In 10 of the proceedings, there were foreign parties involved on both the claimant and respondent side (2009: 10). In total, 59 foreign parties (16.1%) (2009: 57 = 14.4%) (some of the proceedings involving foreign parties were multi-party arbitrations) - out of a total of 366 parties (2009: 396) - from 28 countries (2009: 21) participated in DIS proceedings: Azerbaijan (1), Austria (2), Bosnia and Herzegovina (1), Bulgaria (2), Canada (2), Chile (1), China (1), Croatia (1), Cyprus (1), Denmark (2), France (5), Hungary (2), United Kingdom (2), Hong Kong (2), Italia (2), Latvia (2), Luxemburg (4), Monaco (2), the Netherlands (9), Norway (1), Poland (1), Rumania (1), Russian Federation (2), Switzerland (4), Taiwan (1), Turkey (3), Ukraine (1) and USA (2).

26 of the cases newly filed in 2010 (= 18%) were conducted in English (2009: 24 = 14%).

In 13 cases (2009: 14) more than one party was involved on the claimant side; in 17 cases (2009: 31) more than one party was involved on the respondent side.

In 2010, substitute appointments of arbitrators were made in 28 instances (2009: 16). 25 substitute appointments were made in DIS arbitration proceedings. In 10 cases (2009: 3) the chairperson of the arbitral tribunal, in 12 cases (2009: 7) the sole arbitrator and in 3 cases (2009: 6) the arbitrator for the respondent was nominated by the Appointing Committee of the DIS. Further, the DIS Appointing Committee appointed one sole arbitrator in an arbitral proceeding under the UNCITRAL-Arbitration Rules and appointed an arbitrator in 2 ad hoc proceedings, in which the parties had agreed on the DIS as appointing authority.

10 proceedings were filed under the DIS Arbitration Rules for Sport.

1 mediation/conciliation proceeding was filed under the DIS Mediation/Conciliation Rules.
